The importance of electronic evidence in civil proceedings

An overview of the types of physical evidence, in particular electronic documents, as well as the problem of admission of this type of evidence in court is performed. Social relations, which are the result of formation, receipt and use of electronic evidence in civil cases, are investigated. The aim of the work is to investigate procedural norms, law enforcement practice, definition of electronic documents and evidence, to identify the problems of legal regulation of this issue. According to the results of the analysis, the problems of admission of this type of evidence in law enforcement practice was revealed, therefore it was proposed to make electronic documents a separate type of evidence, to change the procedure for their acceptance, to clearly prescribe the methods of certification of information and identification of persons involved in correspondence in order to regulate the legislation.
